Maintenance obligation and statutory guarantee

The agreement of 17 July 2001 between the European Commission and the German federal government and states (the Brussels agreement) led to a fundamental change in public liability (maintenance obligation and statutory guarantee) with respect to the Sparkassen and Landesbanken.

  • The maintenance obligation was replaced from 19 July 2005 by a normal ownership relationship between the guarantors and the bank. This new relationship complies with market conventions and is acceptable under EU provisions on state aid.
  • The changes made to the statutory guarantee provide for liabilities that existed on 18 July 2001 to be covered in full by the statutory guarantee for their entire term. Liabilities assumed after this date are covered by statutory guarantee provided that they were created prior to 19 July 2005 and that their term does not extend beyond 31 December 2015.

Helaba’s legal foundations (the Treaty on the Formation of a Joint Savings Banks Organization between the states of Hesse and Thuringia and the Helaba Charter) were amended in line with the agreement reached with effect from 19 July 2005.
